Is a Protective Order the Right Approach for Your Case?
In Nevada, the courts can grant temporary protective orders to anyone who has been battered or threatened with domestic violence by a current or former spouse, parent, guardian, relative, boyfriend, girlfriend, roommate or other cohabitant.
Protective orders are very effective at protecting people who have been threatened with domestic violence, but they should not be used for other purposes.
Because protective orders are temporary, the process should not be used to attempt to address any long-term concerns you may have about child custody. Any custody rights granted in a protective order will be revisited in one year if not sooner.
The protective order process also should not be used to gain a perceived advantage in divorce proceedings. While legitimate domestic violence concerns often do come up during divorce cases, false allegations can be extremely damaging to both parties in the long run.
